The use of the website implies full acceptance of the general conditions of use described below. These conditions of use may be modified or completed at all time; users of the website are therefore advised to check them on a regular basis.

This website is meant to be accessible for users at all time. However, may decide of a break for technical maintenance purposes, in which case it will try its best to previously indicate the time of the operation to the users.

The website is updated on a regular basis. In the same way, this legal notice may be modified at all time: it is nevertheless binding on the users who should check it as often as possible in order to acquaint themselves with it.

The purpose of the website is to provide information for one or several products that we supply.

It is ascendeo France’s constant endeavour to ensure that the information provided on is as accurate as possible. However, it may not be held liable for any omissions, inaccuracies or deficiencies in updates, whether of its own doing or of that of partner third parties providing the information concerned.

All the information given on is for information purposes only and is likely to change. Furthermore, the information on the website is not exhaustive and is subject to changes that may have occurred since it was put online.

4. Contractual limitations for technical data.

The website shall not be held liable for material damages related to its use. Furthermore, the website users undertake to access the website using an up-to-date equipment, not containing any virus and with an updated browser of the latest generation.

5. Intellectual property and infringements

ascendeo France is the owner of the intellectual property rights or has the right to use all materials displayed on the website, namely texts, images, graphics, logos, icons, sounds and software.

Any reproduction, representation, modification, publication or adaptation of the whole or of parts of the materials of the website, by any mean or process, is forbidden, except in case of prior written authorization of ascendeo France.

Any unauthorized use of the website or of any part of it will be considered an infringement and pursued under articles L. 335-2 and following of the French Code de la Propriété Intellectuelle.

6. Liability limitations

ascendeo France may not be held liable for direct and indirect damages inflicted to the user’s equipment, while accessing the website, and caused by the use of an equipment not complying with the specifications of paragraph 4, or by a bug or an incompatibility.

Neither may ascendeo France be held liable for indirect damages (as the loss of a market share or of an opportunity) following the use of the website

Interactive zones (possibility to ask questions in “contact”) are available to users. ascendeo France may delete, without prior warning, anything posted in these zones infringing the laws applicable in France, especially the ones about data protection, in which case ascendeo France may also engage the civil and / or penal liability of the user, notably in case of a racist, offensive, slanderous or pornographic message, whatever the medium used (text, photography, …)

7. Handling of personal data

In France, personal data is notably protected by the law n° 78-17 of January 6th, 1978, the law n° 2004-801 of August 6th, 2004, the article 226-13 of the Penal code and the European Directive of October 24th, 1995.

During the use of the website, the following data may notably be collected: the URL addrwess of the links through which the user reached the website, the internet provider of the user and the address of Internet protocol (IP) of the user.

Anyhow, ascendeo France only collects personal data of the user for the needs of some of the services offered by the website. The user supplies this information in full knowledge of it, especially when she / he enters the data himself / herself.

In accordance with the provisions of articles 38 and following of the Law n° 78-17 of 6 January 1978 (the Freedom of Information Act), all users have the right to access, rectify or challenge any personal data about them, by a written and signed request, together with a copy of a signed proof of identity, and specifying the address to which the reply is to be returned.

No personal data of the website’s users is published without their knowledge, exchanged, transferred, given up or sold, by any mean, to third parties. Only the hypothesis of the buyout of the company ascendeo France and of its rights would allow the information to be transferred to the potential buyer who would itself become invested with the same obligation of preservation and of modification of the data of the user of the website.

Data bases are protected by the provisions of the law of 1 July 1998 transposing the European Directive 96/9 of 11 March 1996 relative to the legal protection of data bases.

8. Hypertext Links and Cookies.

The website contains a certain number of hypertext links to other sites, inserted with the approval of ascendeo France. However, since ascendeo France is not able to check the content of the websites visited this way, it shall accept no liability in this regard.

Browsing the website may cause cookies to be installed in the user’s computer. A cookie is a small file that cannot be used to identify the user but that records information about the browsing of a website by a computer. The data acquired this way aims to facilitate subsequent browsing of the website and also to enable various measures of frequentation.

9. Applicable law and competent jurisdiction.

Any conflict arising from the use of the website shall be governed by the laws of France. All litigation shall come under the exclusive jurisdiction of the competent courts in Paris.
